Functions of liability for damage

Abstract

The article deals with functions of liability for damage in civil law. Main part of the article deals with functions of civil liability in Slovak law, which are usually known as prevention (deterrence), compensation and satisfaction. Important part of the article deals with special function of civil liability that is punitive function, unknown in most of the civil-law countries. On the other hand, exemplary damages are well-known in common law countries where they exist for quite a long time. The article also tries to explain functioning of exemplary damages in English law and to show reasons why it is not possible to award exemplary damages
in most of the civil-law countries.
